General terms and conditions Fan Peloton

Article 1: Definitions and Applicability

1.1. In these general terms and conditions, the following definitions shall apply:

a. Fan Peloton: three memberships for fans of Team Visma | Lease a Bike. These memberships are different in nature. Either a free membership or one of the two paid memberships can be taken out.

b. Member: the natural person or business customer (company) who has a membership with the Fan Peloton of Team Visma | Lease a Bike.

c. Membership: the membership of the Member of the Fan Peloton with Team Visma | Lease a Bike.

d. Paid Membership: Members with a paid Membership have access to exclusive content and discounts with partners of Team Visma | Lease a Bike.

e. Team Visma | Lease a Bike: the legal entity (in this case Team Yellow B. Cycling B.V., h.o.d.n. Team Visma | Lease a Bike) with which the Member has entered into a Membership).

1.2. Applicability

These terms and conditions are applicable to each Agreement between Team Visma | Lease a Bike and Member. By entering into the Agreement, Member accepts these General Terms and Conditions.

Article 2: Agreement
The Agreement between Team Visma | Lease a Bike and Member is established by the conclusion of a Membership via teamvismaleaseabike.com/fanpeloton.

Article 3: Payment and Cancellation
3.1 Payment
Payment of Membership takes place prior to the specified period in the manner accepted by the Member when entering into Membership. Membership prices and the payment terms that apply can be found at teamvismaleaseabike.com/fanpeloton. In the case of direct debit, the membership fee is collected from the account number provided by the Member to Team Visma | Lease a Bike.

In case of non-timely payment by the Member, whether or not due to reversal of debited amounts or due to an insufficient balance on the specified account, Team Visma | Lease a Bike is entitled to charge reminder costs. If payment of the Membership has not been received even after reminder, Team Visma | Lease a Bike is entitled to suspend or terminate the execution of the Membership with immediate effect, without prejudice to the right of Team Visma | Lease a Bike to claim any damages and overdue payments. In such cases Team Visma | Lease a Bike is also entitled to transfer the claim to a collection agency. The costs of this will also be charged to the Member.
All Membership fees are in Euros and include VAT. Membership fees and other statements regarding the conditions under which a Member obtains a Membership are subject to spelling and typing errors.

If Membership is changed by the Member to a more comprehensive Membership in the interim, any Membership fee already paid in advance by the Member will be deducted pro rata from the price for the new Membership. The Member will not receive a new welcome pack.
The paid Membership is automatically charged to the Member on a monthly basis after conclusion of the Membership. A Membership is entered into for the specified period of 12 months. Unless otherwise stated in the offer, thereafter - unless cancelled via the account environment at www.teamvismaleaseabike.nl - the Membership will automatically continue for a period of 12 months.

3.2 Modification
Team Visma | Lease a Bike reserves the right to change the price of the Membership during the term of the Membership. Such modification will be published on www.teamvismaleaseabike.nl before the modification date.

3.3 Cancellation
Cancellation of a Membership can be done by the end of the Membership term with a notice period of one month, After automatic renewal after the expiry of the first year, cancellation can be done monthly. The Member can cancel the Membership via the account environment at www.teamvismaleaseabike.com.
In the unexpected case of the death of a customer, the Membership ends at the time, when the death of the customer has been reported to Team Visma | Lease a Bike. In this case, the Membership fee for the as yet unexpired Membership period will be refunded.

Article 4: Termination Fan Peloton
Team Visma | Lease a Bike is entitled to terminate the Membership and associated benefits at any time without giving reasons. In this case Team Visma | Lease a Bike is only obliged to refund the prepaid membership fee paid by the Member.
If the Fan Peloton stops due to circumstances, Team Visma | Lease a Bike will inform the Member as soon as possible.

Team Visma | Lease a Bike is at all times entitled to change the scope, content, title and layout of the Memberships issued by Team Visma | Lease a Bike at its discretion. This expressly includes any name change of the Team.

Article 5: Liability Team Visma | Lease a Bike and Members
5.1. Team Visma | Lease a Bike is responsible for the proper execution of the obligations arising from the Agreement. The Agreement will meet the reasonable expectations the Member may have of the Membership.

5.2 Participation is at the Member's own risk.

5.3 Team Visma | Lease a Bike is not liable for any damages, by whatever name, which the Member may suffer as a result of the participation, unless such damages are the direct result of Team Visma | Lease a Bike's intent or gross negligence.

5.4 This exclusion of liability also applies to serious damages such as all possible damages resulting from injury or death.

5.5 If, notwithstanding the provisions of paragraph 1 of this article, liability of Team Visma | Lease a Bike for damages of the Member must be assumed, the obligation of Team Visma | Lease a Bike to compensate such damages shall be limited to the amount paid out by the insurer of Team Visma | Lease a Bike in respect of such damages.

Article 6: Personal data
In order to conclude the Membership, it is necessary to enter some personal data. When concluding the membership, the Member agrees to the privacy statement of Team Visma | Lease a Bike which, among other things, describes how the personal data are processed: www.teamvismaleaseabike.com.

Article 7: Complaints procedure
Team Visma | Lease a Bike organises the Fan Peloton with the utmost care. Nevertheless, there can sometimes be reason for a Member to have a complaint.
A Member should report a complaint regarding any performance by Team Visma | Lease a Bike to Team Visma | Lease a Bike as soon as possible after the defect or damage has been identified. The complaint should be made by telephone or in writing (fanpeloton@teamvismaleaseabike.com) to Team Visma | Lease a Bike. The complaint must be complete, clearly described and, if necessary, accompanied by evidence. Team Visma | Lease a Bike will assess the complaint received within fourteen days.
